U.S. Congressman Proposed TSCA Reform Bill H.R. 5820

On 22 July 2010, President Bobby L. Rush and Henry A. Waxman introduced the Toxic Chemicals Safety Act H.R. 5820. The legislation will amend the Harmful Substances Control Act (TSCA) introduced in 1976 to ensure that the public and the environment can avoid exposure to hazardous chemicals.


To protect the public and the environment, the draft establishes a framework to ensure that all chemicals that the American public may come into contact with must be subject to safety reviews and, if necessary, restrictions on their use. For EPA, the draft establishes a fast way to reduce exposure risks to persistent, bioaccumulative and toxic chemicals, while allowing exemptions for some known safe substances. Under the measures proposed in the draft, EPA's actions will be subject to open and transparent public review, judicial review and avoidance of unreasonable procedural burdens. As a result, the draft submitted today will safeguard public health and the environment while promoting employment and innovation in the United States. Under this legislation, the safety of all chemicals will be reviewed, hazardous chemicals will be restricted or eliminated, new and safer chemicals will be developed faster, and our economy will move towards a sustainable future.


Over the past two decades, there have been many regulatory obstacles that make TSCA often ineffective, so there is growing consensus that TSCA should be modified. Over the past year, the EPA and other stakeholders, including the American Chemical Society and a broad coalition of public health, labor and environmental groups, have issued key principles that list priorities for legislative reform. In addition, many other stakeholders have expressed their views on how to reform the Toxic Substances Control Act.


Recently, the House Energy and Commerce Committee will vote on the Toxic Chemicals Safety Act to protect the public from dangerous chemicals.
